In explanation of how the arrangement came to be made the First Bailiff says that in other cases where ships have been seized supplies for the crew have been found in a similar manner and that at the time of making the arrangement with the Auctioneering & Brakering Co. Ltd. the financial position in the Colony was such, owing to the strike and boycott, that it was impossible to obtain credit from any ordinary ships chandlers. Such credit, he says, would ordinarily be obtained by the First Bailiff and the creditor would in due course be paid out of the proceeds of sale.

Strike and boycott conditions prevented an early sale of the S.S. Ling Nam", which was put up for auction on the 25th February, 1926, without attracting a bid, and the vessel was not sold until the 1st November, 1926, when the appraisement had been reduced from $270,000 to $150,000.

The full crew of fifty eight appears to have been retained until October, 1925, when the number was cut down to twenty six. Mr. Melbourne states that he had no knowledge of the numbers retained. He was not, apparently, consulted as to their retention.

The First Bailiff states that he conferred with the master who regarded the numbers retained as essential for the safety of the ship, for her protection from deterioration and against danger arising from typhoons.

After lying in harbour and in Kowloon Bay from the 4th May to 6th July, 1925, the ship was removed to dock at Aberdeen, where she remained till December, 1925. This retention in dock was considered by the Hong Kong & Whampoa Dock Co. to be essential for the ship's safety and in this

the master concurred.
